Despite President Trump’s commanding margin of victory last November, the left has hamstrung the Trump Administration with some 200 lawsuits to stop his deportations of dangerous foreigners, downsizing of government, and ending the funding of harmful projects. These lawsuits brought by liberal nonprofits frustrates the will of the people!
From the usual suspects of certain appeals circuits to new names like the now-infamous Judge Boasberg, the left has drummed up what seems an infinite amount of money and free legal time to try to thwart Trump at every turn. Presidents Biden, Obama, and Clinton filled the federal judiciary with hundreds of judges who welcome these lawsuits.
You and I may have thought the lawfare against Trump was over, but the left’s love of litigation has simply shifted from Trump the man to the Trump Administration. Thankfully, John Sauer, the man who overcame the lawfare against candidate Trump such that he could be elected president, is the new Solicitor General in charge of cases before the Supreme Court. He is going to be very busy appealing and overturning these activist rulings by lower court judges fighting Trump’s mandate to Make America Great Again.
One of the epicenters for ultimately answering legal questions about President Trump’s authority is the Supreme Court, which is currently hanging in a precarious 6-to-3 balance. Or is it 5-to-4? Unfortunately, the Republican nominated justices, even Trump’s own appointees, have not proven trustworthy to rule on what seems to be clearly constitutional decisions. However, on a positive note, many (though not all) of these lawfare lower court rulings are being quickly addressed and properly decided at the High Court.
What is not so positive, however, is the realization that we are just weeks into a four-year term. If the last four years are any indication, the radical left and their multitudinous nonprofits, with money and lawyers to burn, will not stop throwing lawsuits at this administration. We need broad and decisive action from the Supreme Court to stop the advance of Lawfare 2.0 against Trump and the will of the people.
