The Mukwonago Area School District’s policy says students must use bathrooms and locker rooms corresponding with their, “original sex assigned at birth.” A federal district court said that policy was unenforceable and up until last Thursday, the Seventh Circuit Court of Appeals had agreed with the lower court. In light of a recent US Supreme Court decision on the transgender issue, the Seventh Circuit Court now is asking for both sides to submit new briefs supporting their arguments.

Landmark decisions such as the US Supreme Court has handed down in the last month have real-life implications even for us in Wisconsin. Mukwonago School District now has an opportunity to prove that their law does not violate the Fourteenth Amendment or Title Nine—but does protect the well-being, privacy and safety of all students.
