Wisconsin Institute for Law and Liberty filed a complaint last week with the U.S. Equal Employment Opportunity Commission defending Spencer Wimmer, who was fired from Generac Power Systems. Wimmer requested a religious exemption from using names or pronouns inconsistent with some coworkers’ biological sex. His manager denied the request deeming Wimmer’s position a violation of company policy. WILL’s complaint asserts that the company violated Title VII of the Civil Rights Act which prohibits religious discrimination.
Both the US Constitution and our state constitution give every citizen the right to express and live by their religious beliefs. This case is especially important in light of a recent US Supreme Court decision that said employers must make such accommodations unless not doing so would result in substantial increased business costs.
